DELHI MODEL UNITED NATIONS (DELHI MUN)

TERMS AND CONDITIONS OF REGISTRATION & PARTICIPATION

By accessing, browsing, or submitting a registration application on the Delhi Model United Nations registration portal ("the Portal", "Website") or attending the conference ("Delhi MUN", "the Conference", "we", "us", or "our"), the user/participant (hereinafter "Delegate", "Applicant", or "User") agrees to be bound by the following Terms and Conditions. Pursuant to the Indian Majority Act, 1875, if the Delegate is under 18 years of age, by the very act of using this Website and registering, they explicitly warrant and declare that they have already obtained the full, informed, and legally binding consent of their parent or legal guardian to participate and to accept this agreement in its entirety.

1. Registration, Eligibility, and Capacity

  • Absolute Discretion: Submission of an application and payment of fees via the Portal constitutes an "offer" under the Indian Contract Act, 1872. It does not constitute guaranteed acceptance. The Delhi MUN Secretariat retains the absolute right to accept, waitlist, or reject any application at its sole discretion.

  • Parental Consent Warranty: By completing the registration process, any Applicant under the age of 18 legally guarantees that their parent or legal guardian has reviewed, understood, and consented to these Terms and Conditions. The Delhi MUN Secretariat reserves the unconditional right to request physical or digital proof of such parental consent at any time. Failure to produce valid proof upon request will lead to immediate disqualification and forfeiture of all fees.

  • Information Accuracy: Delegates must provide accurate and verifiable information. Fraudulent misrepresentation, identity theft, or submission of forged documents will result in immediate disqualification, expulsion, forfeiture of all fees as liquidated damages, and potential legal action.

2. Portal Usage, Account Security, and Prohibited Activities

  • Account Confidentiality: If the Portal requires account creation, the User is solely responsible for maintaining the confidentiality of their login credentials. Delhi MUN shall not be held liable for any unauthorized access, application modifications, or data loss resulting from compromised passwords.

  • Prohibited Conduct: Users are strictly prohibited from:

    • Attempting to hack, disrupt, or compromise the security or integrity of the Portal.

    • Using automated scripts, bots, scrapers, or crawlers to extract data or bypass the registration queue.

    • Uploading files containing malware, viruses, or inappropriate/illegal content.

    • Impersonating another individual or institution.

  • Service Disruption: Delhi MUN provides the Website on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or terminate the Portal (or any part thereof) for maintenance or other reasons without prior notice.

3. Payments and Financial Transactions

  • Payment Processing: All financial transactions on the Portal are exclusively and securely processed in real-time through our official payment provider, Zoho Payments (Zoho Pay). Payments are made directly within the Portal via an embedded Zoho Payments widget and may also involve a redirect to Zoho's secure environment for certain payment methods (e.g., Net Banking, UPI redirect). By initiating a payment, the User agrees to be bound by Zoho Pay's respective processing conditions and terms of service. No manual payment methods are accepted.

  • Accepted Payment Methods: Zoho Pay supports UPI, credit/debit cards, net banking, and wallets, subject to availability and your bank's participation.

  • Transaction Failures: Delhi MUN and Zoho Pay shall not be held liable for any transaction failures, network drops, bank server downtimes, or delayed processing beyond our immediate control. If an amount is deducted from the User's account but not received by Delhi MUN, the User must contact their respective bank or raise a dispute through Zoho Pay.

  • Double Deductions: In the event of a verified double deduction due to a technical glitch, the excess amount will be refunded after thorough reconciliation with Zoho Pay, subject to standard banking and payment gateway timelines.

4. Intellectual Property Rights

  • Ownership: All content on the Website, including but not limited to the Delhi MUN logo, branding, text, graphics, user interfaces, visual interfaces, code, background matrices, and study guides, is the exclusive intellectual property of Delhi MUN and is protected by Indian copyright and trademark laws.

  • Restriction on Use: Users may not copy, reproduce, republish, upload, post, publicly display, translate, or distribute any part of the Website without the express prior written consent of the Delhi MUN Secretariat.

5. Committee and Portfolio Allotments

  • Finality of Decisions: Committee and country/portfolio allocations are made entirely at the discretion of the Secretariat. Once assigned via the Portal or email, allotments are final and binding.

  • Right to Modify: Delhi MUN reserves the unilateral right to modify, merge, or cancel committees, or alter the portfolio matrices prior to or during the conference without prior notice.

6. Code of Conduct and Disciplinary Action

  • Unquestionable Authority: Delegates must strictly adhere to all instructions and rulings made by the Executive Board and the Secretariat.

  • Zero Tolerance Policy: Delhi MUN maintains a strict policy against harassment, discrimination, bullying, smoking, consumption of alcohol, or possession of illegal substances.

  • Immediate Expulsion: The Secretariat reserves the right to immediately expel any Delegate violating the Code of Conduct. Expelled delegates will be removed, forfeit all rights to a refund, and their educational institution/parents will be formally notified.

7. Complete Liability Waiver and Indemnity

  • Technical/Portal Liability: To the maximum extent permitted by law, Delhi MUN disclaims all liability for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Website, including technical glitches that may prevent successful registration before a deadline.

  • Personal Property: Delhi MUN bears zero responsibility for the loss, theft, or damage of personal belongings during the conference.

  • Personal Injury and Health: Participation is at the Delegate's own risk. To the maximum extent permitted by Indian law, Delhi MUN and its partners shall not be liable for any injury, medical emergency, or accident occurring during the conference.

  • Indemnification: The Delegate (and their guardians) agree to fully indemnify and hold harmless Delhi MUN, its Secretariat, and tech providers from any claims, liabilities, damages, or legal expenses arising from their participation or misuse of the Portal.

8. Force Majeure (Doctrine of Frustration)

  • Under Section 56 of the Indian Contract Act, 1872, Delhi MUN reserves the right to postpone, relocate, or restructure the conference (including transitioning to a virtual format) due to unforeseen circumstances, acts of God, governmental/state regulations, server outages, pandemics, or administrative situations beyond our control. Delhi MUN shall bear no liability for any incidental costs incurred by Delegates.

9. Governing Law and Jurisdiction

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with this agreement, the use of the Website, or participation in the conference shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

10. Policy Updates and Amendments

  • Right to Amend: The Delhi MUN Secretariat reserves the unconditional right to update, modify, or amend these Terms and Conditions at any time to reflect changing operational, legal, or financial requirements, without prior individual notice.

  • Agreement to Future Updates: By registering for the conference or using the portal, the Delegate (and their legally binding parent/guardian) explicitly agrees to be bound by the most current version of this policy. It is the User's responsibility to periodically review this document on our Website. Continued participation or use of the Portal after an update constitutes absolute acceptance of all subsequent modifications.
